What I would've done: "Produce the lab results...or we charge you with fraud." Even if they drop the lawsuit, they still get in trouble for causing a stir and it may result in a full stop on suits like this.
Unless of course subway hired people to sue them knowing that the sensational nature of the accusation would garner them free publicity plus allow them to kick off a loss leader marketing campaign of discount tuna sammich sales to boost purchases of cookies. Also gave them an opportunity to humble brag about their product and get that pedophile spokesthing out of people’s minds.
I saw it as basically the other way round. Presumably the newspapers are charging Subway the going rate to take out full page ads, so couldn't the case have been devised by one or more newspapers (or newspaper groups)? I mean if advertising revenue for the paper is a bit lean then fabricate and publish an unfavourable story about a big bucks company, thus forcing them to pay for advertising in the paper to put the record straight. The filing of the court case (more or less knowing it will be thrown out anyway) would in this theory only be necessary to legitimise the original article and prevent the paper itself from being sued for publishing false information, since the first article is then only publishing the detail of the claimaint's allegations rather than publishing allegations of its own.
New theory: Subway paid actors to sue them so they can promote their Tuna Fish Sandwich and get MatPat to say that the previous lawsuits were nonsensical.
Pretty risky marketing strategy. Everyone involved could face charges. Frivolous Litigation for wasting the court's time would be just a slap on the wrist. Perjury and Fraud would be if they want to really punish them for it.
Seems more likely than the fish being fake. And people doubt how much companies get away with things. Remember how long the McDonald's Monopoly scam went without being caught? Seems possible to me.
I would be interested. To know if they actually made a profit off the advertisement campagn about this lawsuit. The idea that Subway (or other big brands) paying people to sue them and go to the press as another advertisement campagn came to my mind halfway though the video.
About that intro, James actually made a point in one of his Sooubway videos (I think it was the second one) about how they're only supposed to put 6 olives but he put more anyway
I feel like if the media really wanted to slander Subway, they'd bring up Jared every chance they got. Like, "how can you trust a company that hired a pdf file as their spokesman?" Or bring up the exploitation of their franchise owners.

(doubt anyone would get the refrence, but yea. as long as they get talked about, no matter if good or bad, they are staying relevant. How do you thing the Pauls got so much clout?)
I had a similar thought... A possibility here is that Taco Bell, and now Subway, only sued themselves to get the opportunity to give themselves more PR. I mean, after this video, I know I wanted to order a tuna subway sandwich just to see how it tastes... and I'm sure (if it actually is just a ploy for marketing) that's exactly what they want you to do. Now, it is possible that it really is just a random case from a couple of morons trying to make Subway lose money, but you can't rule out the possibility that they're just doing it to themselves for PR lol
It’s adorable how you claim these restaurants are suing themselves and yet provide no evidence. If they just wanted publicity, you know there’s far better ways to go about it than potentially damaging their image forever right? Most people who see headlines such as “Subway Tuna is not real fish?” don’t care enough to actually look into it and they might be lead into believing the lie. Why in God’s name would Subway want that? Just so they can put their tuna at 15% off-marketing that most people who see the headlines aren’t actually aware of in the first place?
My cousin is a chemist and she was asked to get “the Subway smell” out of Subway bread. It didn’t work but my grandma had a huge bag of Subway dough. lol
I've also never ordered their tuna, at least not for myself. My grandma used to eat their tuna sandwiches and seemed to really like them. The few times I have tried tuna out I've generally not been too big a fan as it's usually a lot of mayo. The way I make it at home is to use tarter sauce (which I think has mayo in it but you'd never know), Dijon mustard, minced garlic, dill pickle relish, some seasoning (I change it up), and some shredded cheese, sometimes I'll add hot sauce. I've cut out most bread (dieting) so I just eat it straight outta the bowl.

What I would've done: "Produce the lab results...or we charge you with fraud."
Even if they drop the lawsuit, they still get in trouble for causing a stir and it may result in a full stop on suits like this.
Not fraud, defamation of character.
@@FtanmoOfEtheirys No...definitely fraud as there is an attempt to get money from their actions.
@@gamemasteranthony2756 More like extortion.
@@Tim.Stotelmeyer Hmmm...yeah, you may be right. Still...either way, they be in trouble if they don’t give up the lab results.
Plottwist: The two were actually hired by Subway to make the lawsuit, so that Subway can get the attention and basically free ads in the newspaper xD
its all coming together now
I mean, there is no such thing as "bad" publicity.
thats what i was thinking!
m.ruclips.net/video/nrSXw-VMMUI/видео.html
Plot twist: every video matpat makes about a lawsuit will be used by who he said was right

@@JustAnthon it’s not tuna though 🤨
New theory: Subway paid actors to sue them so they can promote their Tuna Fish Sandwich and get MatPat to say that the previous lawsuits were nonsensical.
Pretty risky marketing strategy. Everyone involved could face charges. Frivolous Litigation for wasting the court's time would be just a slap on the wrist. Perjury and Fraud would be if they want to really punish them for it.
@@kevinj8700
It's basically like saying you call the cops to report a crime, even though everyone involved was in on it.

It’s adorable that MatPat doesn’t realize the restaurants are suing themselves.
Correction: It's brilliant how he *pretends* not to know, so that he can spread the facts without getting sued for defamation of character.
Wait what? You have to give me the details! What is going on?
wait is that true

I've also never ordered their tuna, at least not for myself. My grandma used to eat their tuna sandwiches and seemed to really like them. The few times I have tried tuna out I've generally not been too big a fan as it's usually a lot of mayo. The way I make it at home is to use tarter sauce (which I think has mayo in it but you'd never know), Dijon mustard, minced garlic, dill pickle relish, some seasoning (I change it up), and some shredded cheese, sometimes I'll add hot sauce. I've cut out most bread (dieting) so I just eat it straight outta the bowl.
